Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and cesh (“cesh,” “we,” “us”) covering your use of cesh.app and the per-league subdomains we host (collectively, the “Service”). By using the Service, you agree to these Terms.
Who can use cesh
cesh is offered to amateur sports leagues, tournament organizers, and similar organizations (each, a “League”) that operate concession stands, along with the volunteers and parents who interact with their schedules and menus.
- Leagues become tenants when an authorized manager creates an organization on cesh. The League is responsible for the conduct of its managers.
- Managers sign in by email link. By adding a manager email to a League, the existing managers represent that the person is authorized by the League to act on its behalf.
- Volunteers use the public-facing scheduling, menu, and donation pages without creating an account.
You must be at least 13 years old to use the Service. Managers must be adults authorized by their League.
Sign-in and account security
We authenticate managers through one-time sign-in links sent to the email address on file. Keep your email account secure; anyone who can read your email can sign in as you. If you believe your access has been compromised, contact us at the address below.
Volunteer signups and cancellation
Volunteer shifts and rosters are organized at each League’s direction. cesh facilitates the signups but does not commit to any staffing level, attendance, or other outcome. Every volunteer claim includes a private cancel link; volunteers may release their own slot at any time without contacting the League’s managers, and cesh will honor that cancellation.
Acceptable use
You agree not to:
- Use the Service to send unsolicited bulk email, harassment, defamation, or content that violates applicable law.
- Misuse volunteer contact information collected through the Service for any purpose unrelated to operating the League’s concession stand.
- Add a person as a manager without their permission and the League’s authorization.
- Probe, scan, or interfere with the security of the Service or other tenants’ data.
- Resell, sublicense, copy, or scrape the Service or its contents without our written permission.
Your data
You retain ownership of the information you put into cesh — your menu, shifts, volunteer roster, divisions, donations, and the like. You grant us the limited rights necessary to host and operate the Service for you. We will not use your data to train models or for any purpose unrelated to providing the Service. How we handle personal information is described in our Privacy Policy.
Availability
During early access, cesh is offered as-is with no service-level commitment. We may take the Service down for maintenance, upgrades, or to respond to incidents. We will use reasonable efforts to communicate planned downtime in advance.
Fees
cesh is currently free to invited Leagues. We may introduce paid plans in the future. If we do, we will give existing Leagues advance written notice before charging them and an opportunity to decline.
Termination
Either you or we may terminate this agreement at any time. We may suspend or terminate access immediately if you violate these Terms or if we reasonably believe your use of the Service poses a security or legal risk. On termination, we will provide a reasonable opportunity for the League to export its data before deletion, except where prohibited by law.
Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, cesh disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific results will be achieved.
Limitation of liability
To the maximum extent permitted by law, cesh’s total liability arising out of or related to these Terms or the Service will not exceed the greater of (a) the fees you paid us for the Service in the twelve months before the claim arose, or (b) one hundred US dollars ($100). cesh will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, even if we have been advised of the possibility of such damages.
Indemnification
Each League agrees to indemnify and hold cesh harmless from any claims, damages, or expenses arising from (a) the conduct of its managers or volunteers, (b) content the League posts through the Service, or (c) the League’s breach of these Terms.
Changes
We may change these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Herkimer County, New York, and each party consents to that jurisdiction.
